Maenam is an increasingly popular area on the north coast with some nice sandy beaches looking towards Koh Phangan. Stretching some 6 kilometers between Ban Tai and Bophut with numerous hotels and restaurants along the road. Hotels range from the high quality Nappasai, Santiburi Resort and W Retreat to many smaller beach front properties. Samui’s only 18 hole golf course is at the Santiburi Samui Country Club in the hills with magnificent sea views as you play the course. There are many bars and restaurants along the main road and on the side streets leading to the beach. The new Samui Immigration Office is situated here. The Lomprayah Ferry leaves from the western end of the beach taking passengers to nearby islands. Allow 25-30 minutes to the Airport.
The land comprises two rectangular Chanot title of similar size situated just off Soi 1 in Maenam and not far from the Samui Immigration Office.
The land is situated in Zone 6.3 of the The Koh Samui, Suratthani, City Planning Ministerial Regulation BE 2549
Zones 6.1 to 6.11 are rural and agricultural areas. Land here is to be used for agricultural purposes, or any activity relating to agriculture, residence and tourism. In the event that any land is used for other acceptable purposes, then a maximum of 20% of the whole may be used. The list of prohibited buildings in these zones is more extensive and includes: buildings for commercial purposes, except as part of a residential development. And they must be no bigger than 10% of the whole; any residential, commercial or industrial building with a floor space exceeding 2,000 sqm or a height of over 12m; residential or commercial building purposes, except as part of a residential development and equal to not more than 10% of the whole; condominiums, apartments or dormitories; or residences in commercial buildings except as part of a residential development and equal to not more than 10% of the whole.
The rules for all green zones other than zones 6.3 and 6.9 are: a) and b) as above; c) as above, but with surrounding space of at least 50%; d), e), and f) as above.
In Zones 6.3 and 6.9 among the list of prohibited uses are: any purposes of land allotment, except agricultural purposes; residential purposes, except for single house; and any business which may cause harm to health, under the laws regarding public health.
The rules for 6.3 and 6.9 are:
- a) The total area of any buildings, except hotels, must not exceed 2,000 sqm and the height of any building must not exceed 12m.
b) Where the land is used for residential purposes, including hotels, apartments, and bungalows, the surrounding space must be at least 60% of the whole. - d) Where the land borders a public canal or public water source, the land 6m from the edge must not be used (except for the construction of water transportation facilities or public utilities).
And Zone 2 of the Environmental Regulations 2014 which state:
In Zone 2, the following rules apply (not including rules not directly relevant to real estate):
* Future construction of airports and golf courses is prohibited;
* Future construction of water-dams is permitted, provided construction is not on public land and provided structures do not block access to the beach;
* Construction of hotels is permitted, provided that 50% of the land is left vacant and “green” (i.e., consisting of foliage, trees, etc.) and having native trees;
* Construction of a residential project consisting of ten (10) or more residential units must include approved water and waste treatment facilities.
